To spare you the horrible details of my visits to a long list of web stores, does anyone know where I can find 3Ds max version 4?

Try your local landfill and/or antique stores.
In the rapidly evolving world of 3d software, when something becomes obsolete it's usually gone for good. And Max 4 was obsolete when I started animating, 4 years ago; apparently the jump to Max 5 brought 3d Studio Max leapyears ahead.

Off topic, but where might one happen to stumble upon an .nif importer/exporter?

For Morrowind, there's one on the official elderscrolls.com page. For Oblivion, try niftools.sourceforge.net
