This was most likely fixed at some point. The filtering for the dialogue line "You didn't even catch anyone..." is set correctly to a journal stage (TR_m1_FG_Burglaryextra 20) that the journal is updated to if you fail to catch the burglar, so this shouldn't happen anymore.
